TERMS & CONDITIONS

Welcome to Atomic Shield Coating.

These Terms & Conditions (“Terms”) govern your access to and use of AtomicShieldCoating.com (the “Site”), and any quotes, estimates, communications, products, and services provided by JGYST LLC dba Atomic Shield Coating (“Atomic Shield Coating,” “Company,” “we,” “us,” or “our”).

By accessing our Site or engaging our services, you agree to these Terms. If you do not agree, please discontinue use of the Site and do not purchase or schedule services.

1. SERVICES, ESTIMATES & PROJECT SCOPE

All quotes, estimates, pricing, schedules, and scope-of-work documents provided through the Site, email, phone, or in person are preliminary and subject to final inspection and approval.

Project pricing and timelines are based on visible site conditions at the time of estimate. We reserve the right to adjust pricing, schedule, materials, preparation requirements, or decline service where unforeseen conditions exist.

Examples include, but are not limited to:

  • Moisture vapor transmission or hydrostatic pressure
  • Structural cracking or slab movement
  • Existing coatings or sealers
  • Hidden concrete damage
  • Delamination
  • Surface contamination
  • Improper prior installations
  • Excessive patching requirements
  • Conditions not reasonably visible during initial evaluation

Any additional work outside original project scope may require written approval and additional charges.

2. SURFACE CONDITIONS & CONCRETE LIMITATIONS

Customer acknowledges that floor coating systems are installed over existing substrates and final performance depends substantially on existing surface conditions.

Atomic Shield Coating does not guarantee correction of existing substrate defects unless specifically included in writing.

Natural concrete movement, settling, expansion, contraction, cracking, moisture intrusion, and environmental conditions may affect long-term coating performance.

3. DECORATIVE & METALLIC FINISH VARIATION

Decorative coating systems—including metallic epoxy, decorative flake systems, quartz systems, and specialty finishes—are artisan-applied products.

Customer understands and agrees that:

  • Color variation is normal
  • Metallic movement and marbling are unique
  • Reflectivity and gloss may vary
  • Texture may vary slightly across areas
  • Finished results may differ from samples, photographs, renderings, or previous installations

No two metallic floors will appear identical.

4. CURE TIMES & CUSTOMER RESPONSIBILITIES

Customer agrees to comply with all post-installation instructions.

Customer shall not walk on, drive on, place furniture, clean, pressure wash, or otherwise use coated areas until cure timelines provided by Company have elapsed.

Early use, abuse, contamination, or failure to follow instructions may void applicable warranties.

Customer agrees to:

  • Remove vehicles and personal property before service
  • Provide safe access to work areas
  • Maintain utility access as required
  • Secure pets and children
  • Provide uninterrupted access during scheduled work

Additional charges may apply for delays caused by customer readiness.

5. MOISTURE TESTING & PERFORMANCE LIMITATIONS

Where recommended, Company may suggest moisture testing or moisture mitigation systems.

Customer refusal of recommended remediation measures may limit or void warranty coverage and performance expectations.

No coating system can eliminate active water intrusion or hydrostatic pressure.

6. WARRANTIES & WARRANTY EXCLUSIONS

Any warranty offered by Company shall be governed exclusively by the written project agreement.

Unless expressly stated in writing, no additional warranties are provided.

Warranty exclusions may include:

  • Normal wear and tear
  • Tire pickup or hot tire transfer
  • UV exposure or discoloration
  • Surface scratching or abrasion
  • Chemical exposure
  • Water intrusion or moisture conditions
  • Structural movement or cracking
  • Improper maintenance
  • Impact damage
  • Damage caused by third parties or subsequent contractors

7. MAINTENANCE

Customer agrees to maintain completed surfaces according to Company recommendations.

Improper cleaning methods, abrasive tools, harsh chemicals, excessive pressure washing, neglect, or misuse may reduce coating lifespan and void warranty protections.

8. SLIP RESISTANCE NOTICE

Certain decorative and high-gloss coating systems may become slippery when wet.

Slip-resistant additives may be available upon request; however, no flooring system is guaranteed to eliminate slip-and-fall risk.

Customer accepts responsibility for evaluating suitability of selected finishes.

9. PROJECT PHOTOGRAPHY & MARKETING

Unless otherwise requested in writing prior to project completion, Customer grants Company permission to photograph completed work and use such images for advertising, portfolio, social media, website, and marketing purposes.

No identifying personal information will be published without consent.

10. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, all Site content—including text, photographs, graphics, videos, logos, software, branding, designs, and other materials—is owned by or licensed to Company and protected under applicable intellectual property laws.

No content may be copied, reproduced, distributed, or used without written permission.

11. USER REPRESENTATIONS

By using this Site, you represent that:

  • Information submitted is accurate and complete
  • You have authority to request services
  • You will comply with applicable laws
  • You will not misuse Site functionality

12. PROHIBITED ACTIVITIES

You may not:

  • Attempt unauthorized access
  • Circumvent security measures
  • Scrape or harvest Site content
  • Transmit malicious code
  • Interfere with Site operation
  • Use the Site for unlawful purposes

13. FORCE MAJEURE

Company shall not be liable for delays or inability to perform resulting from events beyond reasonable control, including:

  • Weather
  • Material shortages
  • Utility interruption
  • Transportation issues
  • Labor disruptions
  • Acts of government
  • Natural disasters
  • Events affecting supplier availability

Project schedules may be adjusted accordingly.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Company shall not be liable for indirect, incidental, consequential, exemplary, special, or punitive damages arising from use of the Site or services.

Company’s total liability for any project, service, or claim shall not exceed the amount paid by Customer for the applicable services, except where prohibited by law.

Claims relating to workmanship or materials remain governed by the applicable written project agreement.

15. GOVERNING LAW & DISPUTES

These Terms shall be governed by the laws of the State of Arizona.

Any dispute arising from these Terms, Site use, or services shall be brought exclusively in courts located in Maricopa County, Arizona.

The prevailing party in any legal action may be entitled to recover reasonable attorney fees and costs where permitted by law.

16. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time.

Changes become effective upon posting to the Site with an updated revision date.

Continued use of the Site constitutes acceptance of updated Terms.
